Amicus Brief:

Ayotte v. Planned Parenthood


Family Research Council and Focus on the Family submitted an amicus brief, written by Professor Gerard Bradley of Notre Dame, in the U.S. Supreme Court case of Ayotte v. Planned Parenthood, a case challenging New Hampshire's law requiring parental notice for minors seeking abortions.

This case involves a challenge to a state statute governing access to abortions by minor children. The statue provides that the child's parents must be notified before she can obtain an abortion. Though the statute provides for a "judicial by-pass," it does not contain a "health exception," under which the girl's parents need not be notified if her health is at risk.

The federal courts have broadly defined "health" in this context to include all forms of "psychological" health. The question before the Supreme Court is whether a parental notification statute must contain a "health exception."
