Amicus Brief: Department of Human Services v. Howard


Family Research Council filed this brief along with the Family Council of Little Rock in February 2006 to defend Arkansas regulations protecting children by prohibiting homosexual foster care.

Under regulations issued by the Arkansas Child Welfare Agency Review Board, foster children cannot be placed in homes where there is a practicing homosexual. In this brief Family Research Council argues that the board was within its constitutional authority to promulgate the regulations, which protect the health and welfare of foster care children and are based on the government's interest in morality.

Research shows that a home with a mother and a father is the optimal environment for raising children. Thus, regulations such as Arkansas' are important to protect children from the intentional deprivation of either a mother or a father by placement with a same-sex couple.
